1.1. The website www.diketo.md is administered by Diketo SRL and operates under the commercial name and trademark “DIKETO.”
1.2. The purpose of the Platform is to promote a healthy lifestyle, with an emphasis on balanced nutrition, personal development, motivation, and education for wellbeing.
1.3. Legal, tax, and commercial relationships are entered into exclusively with Diketo SRL, while the “DIKETO” visual identity is used as a public-facing brand.
Purpose and functionality of the website
2.1. The Site has an informational and commercial purpose and offers the following services and content:
2.1.1. healthy-eating and dietary-rebalancing programs;
2.1.2. structured meal plans;
2.1.3. courses and educational programs;
2.1.4. recordings of themed courses and video materials;
2.1.5. recipe books and digital materials;
2.1.6. personalized menus;
2.1.7. nutrition consultations provided by authorized specialists;
2.1.8. informational and educational materials on nutrition and healthy lifestyles.
2.2. The information published does not constitute firm offers, medical recommendations, or legal guarantees and is intended exclusively for educational and awareness purposes.
2.3. DIKETO programs are not medical services, do not diagnose, treat or prevent disease, and do not replace consultation with a doctor or other medical professional.
2.4. The User is responsible for assessing their health before starting any DIKETO program.
2.5. The Site also supports communication through contact forms and online chat and may send informational and motivational messages.
Use of DIKETO programs, courses, and materials
3.1. All programs, courses, materials, and recommendations provided through the DIKETO Platform have an exclusively educational, informational, and motivational purpose. They are developed on the basis of general principles of nutrition, personal development, and a healthy lifestyle and do not constitute individualized medical recommendations, clinical treatment, or specialized therapeutic advice.
3.2. Users are informed that, before starting any DIKETO program involving changes to diet, physical exercise, or other lifestyle components, consultation with a doctor or healthcare specialist is strongly recommended. DIKETO does not provide diagnostic, treatment, or medical counseling services and cannot replace a specialist consultation.
3.3. By purchasing, accessing, or participating in any DIKETO program, the User assumes full responsibility for the interpretation, application, and implementation of the information and recommendations provided. DIKETO is not liable for:
3.3.1. individual decisions concerning nutrition, physical exercise, or other personal behaviors;
3.3.2. adverse effects, imbalances, or other health consequences resulting from incorrect, partial, or unadapted application of the information;
3.3.3. failure to consult a medical professional beforehand;
3.3.4. results that differ from the expectations expressed by the User.
3.4. DIKETO and its team assume no liability for any direct or indirect damage of any nature arising from the use of the services, programs, or materials offered. Access to and application of them take place exclusively at the User's own risk.
3.5. All materials made available within DIKETO programs, including but not limited to text, images, graphics, video files, course structures, plans, and recipes, are protected by copyright and are the property of S.R.L. COMDIKETO. DIKETO SRL holds the right to use them. The following are prohibited:
3.5.1. reproducing, distributing, publishing, transmitting, or modifying the materials for personal, commercial, or informational purposes without DIKETO's prior written consent;
3.5.2. sharing, copying, or forwarding the content to third parties, regardless of the form or medium of transmission;
3.5.3. using the materials in other projects, courses, or activities, including online, without express authorization.
3.6. Materials offered within DIKETO programs are confidential and intended exclusively for the person who purchased the program. Transmitting, distributing, capturing, or storing these materials for purposes other than personal use is prohibited. DIKETO reserves the right to restrict access and initiate legal proceedings if abusive use or use contrary to these provisions is identified.
3.7. By using DIKETO programs, courses, or materials, the User declares that they have read, selected, and expressly and unconditionally accept the provisions of this section, assuming responsibility for their correct and informed application.
Intellectual property rights
4.1. All copyright in the website content, including text, images, design, source code, structures, audio-video materials, and other original elements, belongs to Diketo SRL or is used under valid licenses.
4.2. The “DIKETO” trademark is registered and protected in accordance with Law No. 38/2008 on trademark protection.
4.3. Reproduction, distribution, republication, modification, or exploitation of the Site content, in whole or in part and in any manner, without the prior, express, and written consent of the rights holder is prohibited.
Payment and invoicing terms
5.1. The services and products offered through the DIKETO Platform are provided for a fee in accordance with the prices displayed when the order is placed.
5.2. Payment for the services and products offered through the “Diketo” Platform shall be made by bank transfer; their price is set in EUR, and payment shall be made according to the official exchange rate of the National Bank of Moldova applicable on the payment date.
5.3. Payment is made through secure electronic means via authorized payment service providers. DIKETO does not store bank card data and is not responsible for any errors by payment processors.
5.4. Following a purchase, the User will receive a payment confirmation at the email address provided and, where applicable, a tax invoice issued in accordance with applicable law.
Rules for using the website
6.1. Users may access the Site exclusively for personal and non-commercial purposes, in compliance with legal provisions and good morals.
6.2. Any action intended to do the following is strictly prohibited:
a) gain unauthorized access to the administrator's information systems;
b) compromise the security, operation, or technical integrity of the Site;
c) extract content automatically or systematically (scraping);
d) introduce user content without authorization.
6.3. In the event of any abusive use, the Administrator reserves the right to suspend or restrict access and notify the competent authorities.
Return, cancellation, and refund policy
7.1. Access to digital products offered by DIKETO (including programs, materials, courses, video content, or personalized plans) is considered fully and irreversibly provided when they are delivered by email, access link, web platform, user account, or other electronic means.
7.2. Because the products are digital and are delivered immediately after payment is confirmed, the User understands and accepts that, after payment and delivery/receipt of the product, it is no longer possible to request a refund, cancel the order, or return the product, in accordance with the exceptions established by consumer-protection legislation for digital content.
7.3. DIKETO is not required to refund amounts paid if the User has accessed or downloaded all or part of the digital materials or participated in courses, sessions, or communities related to the purchased program.
7.4. Exceptionally, a refund request may be considered only if it is submitted in writing to admin@diketo.md within a maximum of 14 days from the purchase date and only if the product has not been accessed or delivered in any form. The decision to approve or reject the request belongs exclusively to the DIKETO team.
7.5. DIKETO reserves the right to block access for any User who abuses the return policy or breaches the provisions of this document.
Confidentiality and data protection
8.1. Personal data is processed in accordance with Moldova Law No. 195/2024 on personal data protection, applicable national acts, and the principles of Regulation (EU) 2016/679 (GDPR).
8.2. Diketo SRL, as controller, observes lawfulness, fairness and transparency; purpose limitation; data minimization and accuracy; storage limitation; integrity and confidentiality; and accountability.
8.3. Data supplied through registration, orders, requests and questionnaires may be processed, together with technical data such as IP addresses and online identifiers.
8.4. Depending on the purpose, the legal bases are performance of a contract and pre-contractual steps, legal obligations, legitimate interests, necessary communications, and consent only where processing relies on consent.
8.5. Consent must be freely given, specific, informed, unambiguous, and expressed by a clear affirmative action.
8.6. Separate choices are provided for separate consent-based purposes so the User can expressly agree or refuse.
8.7. Silence, inactivity, continued use of the Site, and pre-ticked boxes do not constitute consent.
8.8. Consent may be withdrawn at any time as easily as it was given. Withdrawal does not affect prior lawful processing; processing may continue when another valid legal basis applies.
8.9. Health information, conditions, allergies or intolerances voluntarily provided in a questionnaire are processed only as necessary for the personalized service and only under an applicable legal basis, including explicit consent where required.
8.10. Data is retained only as long as necessary for the stated purposes and legal obligations, then deleted or anonymized.
8.11. Data subjects have rights to information, access, rectification, erasure, restriction, objection, portability, consent withdrawal, protection from solely automated decisions in cases provided by law, and complaint to the supervisory authority.
8.12. Rights may be exercised by contacting admin@diketo.md. Identity verification may be required before a request is completed.
8.13. Data may be shared only as necessary with IT and hosting providers, payment processors, accountants, communications and marketing providers, subject to appropriate contractual and legal safeguards.
8.14. The Administrator applies appropriate technical and organizational measures against unauthorized access, alteration, loss, or disclosure.
8.15. Personal data breaches are assessed and documented and, when required by law, reported to the competent authority and affected persons.
8.16. Strictly necessary cookies support security and essential functions. Optional analytics or marketing cookies are activated only after the User's express choice, which can be changed or withdrawn in privacy settings.
Changes to the terms
9.1. The Administrator reserves the right to amend these terms at any time. Any amendment takes effect on the date it is published on the Site.
9.2. Continued use of the Site after amendments constitutes tacit acceptance of the new Terms.
Applicable law and jurisdiction
10.1. This Agreement is governed by the laws of the Republic of Moldova, including the Civil Code, the Law on electronic commerce, the Law on consumer protection, and the Law on data protection.
10.2. Any dispute shall first be resolved amicably. Otherwise, jurisdiction belongs to the courts of Chișinău municipality.
